COVERAGE RULES FOR THE YLA SHIPPING INSURANCE PROGRAM

1. Definitions:

  • Carrier means the company that is transporting the Parcel covered by this program.
  • Insured means the individual(s) who have elected to purchase insurance through this program.
  • Parcel means packages or shipments transported through parcel carriers.
  • Goods means the YLA products purchased on the order containing the purchased insurance.
  • YLA means the agent, Young LA Trading Company, LLC.
  • Total Insured Value means the total value of the item(s) declared for insurance coverage and can include shipping fees. Includes the carrier provided coverage, if any.
  • Order means a valid order placed by Insured on the website www.youngla.com and on which insurance has been purchased.
  • We, us, and our mean YLA.
  • Theft means a Parcel that is stolen outside of a residence or business where it has been commercially delivered, with intent to deprive the rightful owner of the contents.

2. Coverage:

Coverage provided is for all risks of physical loss or damage from an external cause (subject to exclusions) while in transit, and physical loss or damage from theft upon delivery. Coverage is on a package-by-package basis. Inbound shipments are not covered.

Coverage is for loss, damage, or shortage to the original merchandise shipped plus the original shipping cost (if declared), only. Insured shipments must be made through www.youngla.com in order to be covered.

You acknowledge that the insurance coverage is provided by YLA. YLA is a non-admitted insurer.

3. Limits:

This insurance covers the Goods within any Parcel that is covered by YLA Shipping Insurance. If there are multiple Parcels in a single order, only the Goods lost or damaged in the missing Parcel are covered.

  • YLA Shipping Insurance only covers one (1) reshipment of Goods or Parcels covered under a claim to the Insured.
  • YLA Shipping Insurance does not cover Orders shipped to the wrong or incorrect address by the Insured.

4. Conditions of Insurance:

CLAIM DISPUTES

  • This program shall be construed and interpreted in accordance with the laws of the State of California. The parties agree that any and all claims or disputes arising out of the program or the performance of the program shall be brought in Los Angeles County, California.
  • The Insured agrees to INDEMNIFY AND HOLD HARMLESS YLA from any loss, liability, damage or costs, including court costs and attorney fees that they may incur due to misreading, misunderstanding, and not following the coverage requirements provided by this program and any applicable endorsements.

CLAIM REQUIREMENTS

  • All packaging material and damaged goods must be kept in the original form as received. Packaging and damaged goods should not be disposed of or released to the carrier before a claim is completed as photographs will be required. Failure to comply will result in the denial of the claim due to insufficient packing.
  • Concealed damage allows for the discovery of loss or damage up to 5 days after final delivery. The loss is deemed to have possibly occurred during the insured transit. Discovery of loss or damage occurring 6 days or later after final delivery is deemed to have occurred while the shipment was NOT in transit, and therefore, is not covered.
  • In case of loss or damage to the covered parcel or freight the following must be completed:
    1. The Insured will file immediate notice of non-delivery, damage, or shortage with YLA. The Insured will not file a claim with the Carrier as all rights to the carrier provided coverage is assigned to YLA.
    2. The Insured will complete a YLA claim, as required below, and provide all required documents to YLA within fifteen (15) calendar days from the date of shipment. If the Carrier has liability and their remittance (Carrier's claim check and stub) or response has not been received by the Insured within the 15-day timeframe, all other claim paperwork must be received by YLA within twenty (20) calendar days from the date of shipment.
    3. A complete claim submission must include:
      • An email to support@youngla.com from the email address you used to place your Order.
      • Subject line: CLAIM for Order #YLA12345.
      • Description of your issue or loss.
      • YLA support staff will investigate and respond with next steps or additional requests.
    4. Once a claim has been accepted and approved by us, prompt reshipment of the Goods or Parcel will be made to the Insured. Reshipments can only be sent to the address on file with the Order.
    5. YLA will rely on the determination of responsibility made by the original Carrier to assist in substantiating the loss.
    6. If the shipment is sent by the United States Postal Service (USPS) or consolidators, and the claim is for a loss of the Parcel while in transit, the Insured must wait twenty (20) calendar days (Domestic shipments) or 40 calendar days (International shipments) before filing claim with YLA for USPS to trace the package. A claim for a loss in transit may only be filed after the Carrier has made a final determination as to the loss.

OTHER INSURANCE

  • This program is excess coverage if there is other insurance coverage. After the other insurance has paid up to its limit, our program will provide coverage up to its limit, but not exceeding the remainder of the loss.

SIGNATURE CONFIRMATION SERVICE

  • YLA may require direct or adult Signature Confirmation Service provided by the Carrier (must be signed for at delivery) for Goods or Parcels reshipped under a claim.
  • Any Orders delivered by a Carrier with a Signature Confirmation Service are not eligible for reshipment if the Order confirmation contains a valid signature.

WEBSITE LANGUAGE:

Your Order will be subject to the Carriers loss or damage policy, if available, if YLA Shipping Insurance is deactivated.

Your Order is protected by YLA Shipping Insurance, giving you peace of mind in the event your Parcel is damaged or lost during transit.
